Terms of use

These terms of use (the “Terms”) govern access to and use of the Take Your Skills service, published by Fleck One (see the legal notice), which allows users to bring together and make the most of the professional recommendations they receive or write.

Take Your Skills also offers an optional personality at work test, described in article 7.

Creating an account on the platform constitutes full acceptance of these Terms and of our privacy policy. If you do not accept these conditions, you must refrain from using the service.

Creating an account requires a valid email address, verified by a six digit code sent by email. You are responsible for keeping your credentials confidential and for any action taken from your account.

You may add several email addresses to your account (personal and work). The primary email address is used for all platform communications. You may delete your account at any time from your settings.

When using Take Your Skills, you undertake not to:

• publish content that is unlawful, defamatory, abusive, racist, sexist, or that infringes the rights of others;
• impersonate anyone or create fake accounts;
• recommend a person without their implicit agreement (that is, recommendations must be truthful and prompted by a professional context);
• scrape, automate or attempt to circumvent the technical measures of the service;
• intentionally harm the reputation of a person or an organisation;
• use the service for unauthorised commercial purposes (bulk sending, spam, canvassing).

Any reported content may be moderated and removed without notice. Accounts in breach may be suspended or deleted.

The recommendations you write remain your intellectual property. You grant Fleck One a non exclusive, free, worldwide licence, for as long as the recommendation is published, to host, reproduce, distribute and display that content as part of the service.

You warrant that your contributions are original, truthful, and infringe no third party right. You may at any time change the visibility (public or private) of your recommendations, or delete them, from your dashboard.

Take Your Skills uses an artificial intelligence model (provided by OpenAI) to summarise your public recommendations into a professional portrait displayed on your profile. That summary is generated automatically, may contain approximations, and does not bind Fleck One as to its accuracy. You may regenerate your portrait at any time (within the monthly quota) or restore an earlier version.

When your personality test result is displayed on your profile, it may be used to shade the wording of that portrait. It is never its source: only your public recommendations are. If you make your result private or delete it, your portrait is regenerated without it.

Description. The personality at work test is an optional, free questionnaire made up of situations from working life. It produces a result that describes work preferences in the form of an archetype, a four letter code and percentage positions on several dimensions.

Visibility. At the end of the test, your result is displayed on your profile, and the result page immediately asks you whether you wish to keep it displayed or make it private. If it is displayed, your result is visible to anyone who views your profile, including without an account, and may be picked up by search engines. It also appears in the PDF document of your profile, in the activity feed of the people you are connected with on Take Your Skills and in the “In your network” list of those people. From your profile or from your result page, the “…” menu lets you make it private (“Make private”) or delete it (“Delete my result”) at any time. Deleting it erases your test sittings, your feedback on the portrait and the displayed result, without deleting your account.

Scope of the result. The result is based solely on your own answers, at a given moment. It is indicative. It is neither a diagnosis, nor a medical or psychological assessment, nor a measure of your skills or of your suitability for a role. The questionnaire has not been scientifically validated. It does not replace the recommendations written by the people who have worked with you.

Prohibited uses. Every user and every visitor is prohibited from:

• using another person’s result to take or support a decision concerning them, in particular as regards recruitment, appraisal, pay, promotion or termination;
• collecting that result by automated means;
• using it in a discriminatory way.

Take Your Skills offers no function to search, filter or rank people by their result, and takes no decision on that basis.

Intellectual property and trade marks. The situations in the questionnaire, the names and descriptions of the archetypes and the explanatory texts are written by Take Your Skills and are the property of Fleck One. Any reproduction without authorisation is prohibited. The test draws on the sixteen type typology arising from the work of Carl Gustav Jung. Take Your Skills is not affiliated with The Myers-Briggs Company, owner of the MBTI trade mark, and uses its own questionnaire.

Take Your Skills uses its best efforts to keep the service available 24 hours a day, 7 days a week. Fleck One cannot, however, guarantee uninterrupted operation and reserves the right to suspend access temporarily for maintenance, technical incidents, or in the event of force majeure, without this giving rise to any compensation.

The service is provided “as is”. Fleck One cannot be held liable for indirect damage arising from use of the service, in particular loss of data, loss of professional opportunities, or reputational harm linked to content published by other users. Fleck One’s liability is in any event limited to the amount actually paid by the user over the last 12 months (to date, the service is free).

Fleck One reserves the right to amend these Terms at any time. Substantial changes will be notified by email to registered users. The applicable version is the one in force on the date of your last action on the service.

You may close your account at any time from the Settings tab of your profile. The consequences of deletion are described in our privacy policy (in particular: the recommendations you have written for others are anonymised).

Fleck One may terminate your access in the event of a substantial breach of these Terms, after a formal notice that has remained without effect for 7 days (except in an emergency, or for a serious breach justifying immediate suspension).

These Terms are governed by French law. Any dispute will, failing an amicable settlement, be submitted to the competent French courts.

These Terms were originally drafted in French. This English version is provided for convenience. In the event of a discrepancy between the two, the French version is the reference version. This does not deprive you of the mandatory protections afforded by the law of your country of residence.
